Terms and Conditions
Thank you for ordering from Artful Cakery by Julie. These terms and conditions serve as the contract between the customer and Artful Cakery by Julie. By placing an order and paying the invoice, the customer is agreeing to these terms and conditions. Terms and conditions are subject to change without notice.
Artful Cakery by Julie reserves dates in the order they are booked and only completes a limited number of cakes per week. If your event date changes, please contact Artful Cakery by Julie immediately for accommodations. Depending on Artful Cakery by Julie’s schedule, it may not be possible to honor all change requests. When an event order has been placed, the process of declining other orders begins. As your event date approaches, the chances of re-booking your date are greatly reduced.
Order Change Requests: Change requests will only be accepted up to 2 weeks prior to the event. These changes include flavor, fillings, size/servings, and design. Changes might result in an additional fee due to any additional expenses incurred or extra planning required by Artful Cakery by Julie.
Delivery and Set-Up: All orders will be delivered and set up by Artful Cakery by Julie unless other arrangements have been agreed upon by all parties involved. Customer will alert Artful Cakery by Julie to any obstacles or hazards such as gravel/dirt roads, steep inclines/declines, long distances to venue from parking areas, etc. that may impact the cake delivery. After the cake has been delivered and set up, Artful Cakery by Julie will take photographs showing the completed cake. Following departure, Artful Cakery by Julie will not be held responsible for any damage to the cake caused by the venue, other vendors, event coordinators or guests, from being touched, moved/relocated, bumped, natural disasters, uneven floors, unsturdy tables, loud music, held at improper temperatures (over 72º F), left in direct sunlight, or any other unforeseen events. Artful Cakery by Julie will not be held responsible for the cake after delivery. Any last minute decisions to relocate the cake or make any changes will be the customer’s responsibility. In the case of an outdoor venue, many factors could affect the cake. The customer claims any responsibility for the cake being damaged if placed outside in the heat, humidity, sunlight, rain, wind, uneven/poor ground conditions, insects, etc.
Cake Pickup: If arrangements have been made for you to pick up your cake, you must arrive at the predetermined meeting place on time. Once the item has left the premises, the customer is responsible for ensuring products get to the destination safely and stored property to achieve best results for the taste and quality. Please be aware that cakes not transported properly can shift, melt, slide, or become otherwise damaged. Do not take curves too quickly, brake hard, drive erratically, carry the cake on a slanted/uneven surface, or store the cake at a high temperature or in direct sunlight.
It is the responsibility of the customer to check the state of the product before leaving the premises. If the order/product is accepted/approved by the customer or an agent thereof, they waive any rights to a refund based on the style, design, or visual appearance of the cake.
Artful Cakery by Julie will not be held responsible for any mishaps regarding the cake after customer accepts the order and drives away.
Colors: Some bright or dark colors may bleed into the surrounding frostings or fade to a lighter shade, especially in outdoor locations or in direct sunlight. Artful Cakery by Julie will attempt to make the colors as close as possible to your wedding colors. Please provide a color sample (ribbon, fabric, paint swatch, etc.) instead of only digital examples of the colors.
Cake Disasters: In the rare occurrence of a cake disaster, Artful Cakery by Julie must be notified immediately if any action is requested. There will be a fee of up to $50 per hour plus mileage if Artful Cakery by Julie must return to the venue for repairs or to assess any damage to the cake.
Food Allergies: All cakes are produced in a kitchen where they may come in contact with or contain eggs, nuts, milk, soy, wheat products, and other allergens. Artful Cakery by Julie will not be held responsible for any allergic reactions that occur from someone eating cake. If there is a known allergy, please advise Artful Cakery by Julie at the time the contract is signed so precautions can be taken. It is the customer’s responsibility to inform guests of the possibilities of allergens in cake.
Serving: Artful Cakery by Julie is not responsible for the disassembling and serving of the cake or any damage caused by doing so. There may be wooden dowels/plastic drinking straws, plastic or cardboard cake plates, toothpicks, and/or bamboo skewers in the cake for structure/stability purposes, all of which must be removed before cake is served to guests. Artful Cakery by Julie will not be held responsible for any injury or other mishap caused by structural parts of the cake not being removed or properly disposed of. Also, Artful Cakery by Julie is not responsible for the serving size provided to guests by the person cutting the cake. Artful Cakery by Julie promises to provide the size of cake and number of servings agreed upon by the customer in the contract. If all guests do not receive cake due to the method of slicing, Artful Cakery by Julie will not be held responsible.
Refunds: Artful Cakery by Julie will endeavor to perform its services in a professional manner and provide the best customer experience possible. No refund will be issued without the return of the cake. In the event that you are unhappy with the delivered cake and feel that it did not meet the description in this contract, you must return the cake in order to be eligible for a full or partial refund. Without proof that the cake was not served at the event, a refund will not be possible. Artful Cakery’s total liability is hereby limited to amounts paid to Artful Cakery by Julie for its goods and services. Artful Cakery by Julie will not be liable for any special, incidental, punitive, or consequential damages, whether foreseen or unforeseen, regardless of whether liability is based on breach of contract, breach of express or implied warranty, negligence, strict liability, tort, or otherwise. In the event that our products or services do not meet our standards, or the client is dissatisfied, we may--at our discretion--refund the amount paid for those products and services
This clause is to protect Artful Cakery by Julie from any fraudulent scheme in which a customer wants to obtain a cake at no cost.
Disclaimer: Artful Cakery by Julie will make every effort to provide all services in a professional and timely manner. Artful Cakery by Julie will not be held responsible for any circumstances beyond its control including, but not limited to: inclement weather, power outages, heavy traffic, road closures, car accidents, mechanical problems, sickness, hospitalization, other emergencies, or acts of God. Artful Cakery by Julie will be responsible for refunding the cost, and no more than the cost of the cake if it is impossible to deliver the cake for any of the above reasons. Artful Cakery by Julie retains the right to make design and structural changes that affect the design of the cake as necessary, without prior notification, even at the last minute. All focus will be on giving you the best cake possible, as close to the design as possible. Any products ordered from an inspiration photo or sketch of a cake or a photo of a product produced by any other business/person will be reproduced by Artful Cakery by Julie as our interpretation of the product and will not be an exact reproduction of the product in the photo. Artful Cakery by Julie makes unique and custom cakes and will not directly copy the art of another.
Photography: Any photographs of cakes taken by Artful Cakery by Julie can be used as desired for display, promotion and marketing, on websites, social media, magazines or other platforms as seen fit by Artful Cakery by Julie with no compensation to the customer at any time in the future.
Flowers: If flowers are provided by an outside source, the arrangement of the flowers is included in the delivery fee. It is acknowledged by Artful Cakery by Julie and the customer that fresh flowers are not a food product. They may contain pesticides, dirt, insects and other contaminants and should be removed before serving cake.
Cake Care Instructions:
Pick up and carry the cake box from the bottom only.
Do not allow sides of box to damage cake.
Keep the cake level at all times including transport and refrigeration.
Transport the cake in an air conditioned vehicle away from loose objects, on a flat surface, not in a seat.
Store cake in the box in the refrigerator for more convenient transportation
Keep away from direct sunlight, moisture, and heat.
Take the cake out of the fridge for 1-2 hours before serving.
Use a sturdy cake stand at least an inch larger than the cake board.
Store the leftover cake in an airtight container after slicing to keep from drying out.
